  •  That's one thing that at least my law school spent (23+ / 0-)

    a lot of time teaching us.  We can use 8-syllable words with an appellate bench but, when it comes to the average client (who may be perfectly intelligent, just not educated in legal terms), it's important for us to use simple language.  Even court documents are becoming more simplified; my generation has stopped using a lot of the archaic and unnecessary parts of pleadings, such as starting all templates with "HERE COMES PLAINTIFF" or, even more ridiculous, "COMETH PLAINTIFF."  I remember snickering when I saw the latter version - I'm not even sure that's grammatically correct.

    I've gradually seen things improve and that's one awesome thing about this administration - I find myself wondering if an order came down from somewhere Upon High to all departments, not just HHS, to take a fresh look at federal publications etc. and make them readable to people who don't have graduate degrees in tax law, English literature and Law French.  If I had my way, I'd do the exact same with my court's documents, but... it's early in my career and my neck doesn't crane far enough back to see the top of my court's totem pole yet.
