    his purchaser didn't qualify and thereby avoid committing a crime.  If the seller went ahead with the sale anyway, he could be charged and jailed.

      This is the most mis-understood part about the current gun selling landscape.

      It is already against the law in most states for a private seller to sell a gun to an unauthorized person.  They simply are not required to do a background check.  They are still required to keep records.

      They can be charged and jailed for selling a gun that is subsequently used in a crime

      under current law.
      Universal background checks would have only formalized that, but may - and this is the important reason I was for it - scare off private sellers from selling to shady characters.

      However - shady characters will stlil get their guns.. only theu will be slightly harder to get and more expensive.

        guns from a dealer in Washington State.  Dealer went unscathed.   So it seems to me that existing legislation needs some tweaking.
