    in our caucus....They seem to have no clue how actually well organized the Tenthers and the NRA et al truly are.....

    There's also the State Constitutions that specifically grant a more obvious personal right to keep and bear for self defense as well as state defense.....Take Arizona's firearms amendment (this exact wording is used in a few State Constitutions)

     

    26. Bearing arms

    Section 26. The right of the individual citizen to bear arms in defense of himself or the state shall not be impaired, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain, or employ an armed body of men.

    Many written contemporaneously with the original BOR so from that and the record, it seems the people had a more expansive view of gun rights than the average anti gun kog.....

    Of course all rights come with responsibilities, like the oft mentioned "no yelling fire in a theatre".....Well that's only kinda right, it isn't illegal to yell fire in a theatre, however, your 1st amendment right to free speech does not protect you from any bad effects of said yell....Like being sued to broke and probably brought up on reckless endangerment charges....

    That's kinda the difference as I see it, gun laws are prior restraint without adjudication while in the fire case you are quite able to yell, you just have to face any bad consequences....Gun laws should be the same and for the most part truly are, you have the right to keep and bear but the 2nd doesn't protect you from misuse of that right through negligence......and I'm one of those gunnies who believes there is no such thing as an accidental discharge, there's only negligent discharge or mechanical failure.....I had a MF once but because I was covered by the other safety rules most gun people live by there was no damage to anything but my shorts....270 fired when I closed the bolt, pointed downrange so no danger, just a scare.......
