    I'm not questioning the legality so much as how exclusive the arrangement is in the grand scheme of things.

    I went to school with a fellow who grew up in Roxbury. I wouldn't be surprised if some of his neighborhood is now gentrified, but when he lived there there were probably pieces of architecture which could have qualified for historical designation and comparable tax treatment for an easement agreement, but since the "wrong" people lived there, no such favorable tax treatment would ever have been created and distributed.
