    If -- and IMO it's a pretty big if -- the donation of the easement was more restrictive than the easement imposed by Cohasset law, then while A deduction may be legitimate, clearly the amount of the deduction must be limited to the value of the house after the donated easement compared to the value of the house with the legally-mandated easement.  

    Gomez appears to have based his deduction on the value of the house after the donated easement compared to the value of the house with no easement at all.
