    which are being filibustered by Republicans to prevent the agency from functioning

    how about judge ships?

    there is already a home-state control of District Court judges and US Attorneys that most of the Senate would uphold under senatorial courtesy even independent of changes in the rules on filibusters

    One last point

    knowing how they have used the filibuster to cripple a Democratic president with a Democratic senate majority, does anyone doubt that with a Republican Senate and a Republican president the Republicans would simply kil the filibuster for their political advantage?

    Glad Levin is retiring -  he still thinks the Senate operates with some comity, as it did when he arrived there.  That has certainly not been true since JAN 20, 2009.
