  •  Because of a corrupt industry (17+ / 0-)

and decades of corrupt congress critters, the oil and gas industry has enjoyed the benefit of exemptions from any environmental definition of a hazardous waste or hazardous material.  That being said, there is not an exemption for a discharge into the waters of the State or United States without an NPDES (National Pollutant Discharge Elimination System) permit.  That includes stormwater runoff with any shite in it into the waters of the State or United States.  The "any shite" doesn't have to be hazardous.

The Clean Water Act has a provision for citizen suits -- which means, any citizen who has standing can give notice of an intent to sue -- said notice is directed to the Koch assholes, the State Dept. of Environmental Protection, the Regional EPA, the Federal EPA, etc.  If the Koch assholes don't rectify the situation in 60 days (or the State doesn't do aggressive enforcement in 30 days) then the EPA can step in and start an enforcement action.

I'm pretty sure there's a few enviro public interest law groups who would be very interested in taking on this matter.

    •  What does it require to have standing in a case (2+ / 0-)

like this? To be a City of Detroit resident? Resident of a community along the Detroit River (or downstream)?
I guess I can make some inquiries locally about what the enviro groups are doing if anything in this regard.

Some DKos series & groups worth your while: Black Kos, Native American Netroots, KosAbility, Monday Night Cancer Club. If you'd like to join the Motor City Kossacks, send me a Kosmail.
