    and are you saying there are no regulations already in place that prohibit dumping this type of stuff out in the open?

      A lot of states have regulations about how petcoke is stored -- California and Texas (if you can believe it) actually have some decent regulations.  These require the petcoke to be stored in a waterproof building with ventilation, air quality monitoring, and other safety precautions.  Meanwhile, the petcoke in Detroit is being stored along the river in the open air.  

      The NY Times article doesn't specifically say who owns the land but you can assume either the refinery or the Kochs themselves do.

      What we're calling for on this is for the Michigan DEQ to enact stricter regulations so that these sorts of piles aren't possible -- petcoke should be stored far more carefully...
