    That's not exactly the way it works.  

    See my comment "this diary overstates the problem" as well as my comment underneath that one.

    If you contest the eviction, you can plead not guilty to the failure to vacate and have it litigated (a process that can take a few months or more).  During the time the proceeding is pending, you can stay in the property, and you pay your rent into the registry of the Court.  If you win, you get your money back.  If you lose, the landlord gets the rent for the months you remained in the property.

      Prosecutors are damned vindictive with people who plead not guilty and don't succeed for any reason. So are a lot of judges for that matter.
