    bill came up short because then, as now, the threat of a crackdown against employers who knowingly hired illegal workers never materialized because political compromises weakened the employer sanctions and because widespread fraud enabled companies to keep hiring illegal immigrants.

      From the text of the 1986 IRCA:

      "(B) USING OF COUNTERFEIT-RESISTANT DOCUMENTS. -- If the system requires that a document be presented to or examined by an employer, the document must be in a form which is resistant to counterfeiting and tampering.
      This 'tamper proof' document never materialized. Alan Simpson has stated on more than one occasion that the Democratic Party spiked the 'tamper proof ID' in committee.

      Along with the 1986 IRCA came 8 USC 1325 and

      8 USC 1324

       Any person who, during any 12-month period, knowingly hires for employment at least 10 individuals with actual knowledge that the individuals are aliens described in subparagraph (B) shall be fined under title 18 or imprisoned for not more than 5 years, or both.

      Without the 'tamper proof ID' it is practically speaking impossible to prove 'actual knowledge'.

      Fast forward to 11/11/12, from the diary link I posted and Senator Schumer's interview:

      Fast forward to today. The 'Gang of Eight' has labeled the 'tamper proof ID' as 'too expensive' at about $40 billion, yet 4.2 billion per year in EITC to illegal immigrants is somehow just okey dokey.
