    The people, like you, who say that it depends who is doing "it" are rightly rebutted by an examination of the poll data.

    1.Checks and balances. In 2006, Americas were reacting to news that the government had not bothered to obtain court approval prior to tracking calls. Now the government loops in the courts. Democrats might think that judiciary involvement makes all the difference.

    Well, duh.  Something about all three branches of government being on the same page means something.
