    but SCOTUS said otherwise which means legally the 4th doesn't apply.

      A sharply divided SCOTUS said, in a single 35-year-old case, that it was OK in the situation of ONE person for whom there basically would have been probable cause anyway. There has never been a decision saying the metadata for tens of millions of entirely innocent people - virtually every American - can be handed over to the NSA, not in the context of a specific investigation of a specific already-committed act, but in the name of some vague standard of "national security."

      None of which addresses the fact that the government can stop short of what a right-wing SCOTUS might let it get away with.

        the decision is the decision and if you reject it because you don't like the answer I don't see much difference between that and the incipient tea party nonsense about the ACA

          The decision is not on point. There is no decision covering metadata for 300 million people all at once.
