    Consent is impossible or at least highly questionable.

    Most obviously, in a prison, jail, or "custody" situation ... "consent" is impossible -- and the laws of most states reflect that fact.

    Likewise, the laws of most states hold that patients in hospitals, minors and (significantly) intoxicated persons are incapable of consent.   (And doesn't this make interesting problems for legally incompetent but "high-function" people, their  parents, educators and caregivers?)

    And for the longest time the Military ASSUMED that sexual favors exchanged across lines of rank were abusive and dishonorable.  Of course, that was before large numbers of women were serving in similar jobs and in equal ranks as men.

    Still ... derailing a few supervisory officers' careers for "failure of leadership." if their subordinate officers and NCO's can't seem to grasp "ONLY 'yes' means Yes." might be a good place to start.
