    This is the kind of situation you get into if you start eavesdropping. What if you hear something other than what you expected to hear. I plant a bug in your office expecting to find out if the rumors about you and your secretary are true, then I actually hear you are planning to off your wife. Now I've gotten myself in the middle of something other than what I intended and theoretically have to take some action about it.

      make some stupid fantasy threat that they have no intention of ever completing, and they only said it because they 'knew' no one was really listening.  And suddenly they're facing jail time for having made a fake threat no one was ever supposed to hear that was just them fantasizing.

        The NSA has to refer the threat to law enforcement agencies. Then they have to do an investigation. In order to obtain the threatening communication, they'd need a warrant, which would require probable cause, and the NSA-provided information wouldn't be admissible in the hearing to determine probable cause.

        Or so says my lawyer boyfriend. Right before calling me a conspiracy theorist.

        But I think he's right on the facts, as far as it goes - I think it would be difficult to get an investigation going based on an NSA tip. Not impossible, but difficult enough that it would only be used for unambiguous admissions of serious crimes, or against people the police already wanted to target.

        There you are, ear pressed to the wall between your offices, hearing statements. "Wish that bitch/SOB was dead". "I know people who could shut him/her up forever".

        Now you are in the peculiar situation of deciding how seriously to take those statements. Blow it off, and he/she gets offed? Take it seriously, report it, and some schmuck who was venting is getting questioned? Anybody who sets out to "snoop" has to be ready for these elthical challenges.
