    Mistrials are typically based on the appeal of someone who is convicted. If Z is found not guilty the prosecution will not appeal the verdict. If there is a hung jury the judge at the next trial will make an independent determination regarding the evidence.

    The remedy for the prosecution is to appeal this ruling on the audio experts now, but that would delay the start of the trial.
