    judges through the normal judicial process, and they have lifetime appointments to those jobs.  Appointments to the FISA court are for 7 year terms, and may not be renewed; they're not lifetime appointments.

      They are federal judges that have been SELECTED by John Roberts for the FISA court.  There's no chance of loose cannons on that court.

        through the normal process.  They all continue as judges of their respective U.S. District Courts.  Chief Justice Roberts (or whoever the Chief Justice is at the time) names them to the FISA court for a 7 year term.  This process isn't as unprecedented as you make it out to be.  For example, federal judges are appointed to Judicial Panel on Multidistrict Litigation by the Chief Justice.  He also has important authority in assigning visiting judges to a court in a circuit other than their own.

          It's true, though, that this can't possibly make for a FISA court that isn't hand-picked by John Roberts.  And since John Roberts has a lifetime appointment, that basically means he determines who is on FISA into perpetuity.  

          Of course, none of this matters if you feel that John Roberts is an unbiased man who wouldn't appoint people based on their willingness to play ball.  

          If you don't feel certain of that, this means that we are stuck on the outside wondering what the hell those guys are doing in secret and if they are watching out for our civil liberties or just showing up for work and rubber-stamping the same old shit every day because it's the patriotic thing to do.

          Which is what seems to be the case based on the statistics.

          You know, with all the recent arguments that start out "You all knew it was this fucked up, so why complain now?  Grow up."  it seems that accepting anything on good faith anymore is just an invitation for another round of that argument.
