    a broader ruling rather than punting which is essentially what SCOTUS did -- that's likely the reason Scalia went along with Roberts to get the issue out of their hair for at least another term or two.

      It's my understanding that the voting process is fluid, and that it can change based on what it appears the end result will be (punt, affirm, reject).

      Justice Sotomayor has been really good during her tenure on the court, so I'm hoping her dissent was indeed because she favored a broader ruling.  Perhaps she will acknowledge this during some speaking session or law school visit sometime in the future.
