      After Justice Samuel Chase was acquitted - by lopsided margins in most cases - "judicial performance", even highly prejudiced/prejudicial performance, was no longer sufficient grounds to impeach.

      Ya gotta catch 'em red-handed with a big fat bribe, or a harem of sheep.

        You can't convict anyone with the bar set that high.

        After studying the history, I am absolutely convinced that Andrew Johnson was guilty as sin and should have been removed from office.  His outright refusal to enforce the Enforcement Act -- which was the implementing legislation for the Thirteenth and Fourteenth Amendments -- was the very definition of an impeachable offense.

        And yet it was impossible to get 2/3 in the Senate to get rid of him.

        Madison claimed that impeachment was the solution to most of the problems with the US Constitutional system -- most of the ways in which the government could become irredemably corrupted.

        But impeachment and removal from office is impossible if it requires 2/3 of the Senate.  So James Madison screwed up, and we're probably going to see the overthrow of the government by extraconstitutional means because of this goddamned roadblock in the Senate.

        they were suggesting a mass-walkout because of people complaining about the loss of the 4th Amendment going on too long.

        Hrm, who wants or needs the participation of people who don't think the constitution, itself, is worth discussing unless the Dem Establishment tells us too?

        I can't imagine an easier decision to make, were it up to me. Which it isn't.
