    When you look at that quote in the larger context of passage in Scalia's dissent it comes from, he is addressing the portion of Kennedy's opinion that basically says the court should review this case to avoid all the cases that will no doubt need to be filed if the court doesn't rule one way or the other. He would much rather have punted in standing, as he did not was to set a precedent.

    Workers of the world, unite! You have nothing to lose but your shackles. It is by the picket line and direct action that true freedom will be won, not by electing people who promise to screw us less than the other guy.
