  •  When you say at panel, when is a decision coming? (0+ / 0-)

    I'll have to start keeping an eye on that.  Paradoxically, it is my understanding (and I'm not an appellate lawyer) that controversial cases can often skip the en banc ruling if the panel's opinions are, per the appellate bench, adequately developed - it takes work to re-hear that kind of case if its final destination is SCOTUS no matter what and if the appellate bench doesn't want to overturn the panel opinion.  That was why people often talked about how exquisitely developed Judge Walker's record was - it was wrapped up in a bow tie to rocket up to SCOTUS.  So if the NV case is in the same position to skate through the rest of the 9th Circuit review, SCOTUS could conceivably grant cert and be issuing a decision next June.

    Again, I am light years from being an appellate lawyer, so this is distant memory - I'll stand to be corrected.
