some of the he said she said - take it with a grain of salt - but it seems as though the Prosecutors have over-charged Zimmerman at this point.  Murder 2 is going to be real tough - manslaughter would have been more realistic.

I don't like how Ms Jentel was beat up in the social media and I certainly am concerned about this too.

I just don't understand why all the hate in this world.

You're correct that manslaughter may have been an easier charge to prove, the problem is that Zimmerman's claim of self-defence (assuming you believe it) is valid whether it's manslaughter or murder...if he reasonably feared for his life or serious injury, he was entitled to defend himself with deadly force.

Having said that, juries do sometimes split the baby in cases like this, and it's entirely possibly that a manslaughter conviction would have been easier to get.

      •  but that can still happen, can't it? (0+ / 0-)

the manslaughter charge is embedded within a murder 2 charge, and they could find on a lesser account of aggravated murder, no?

Sourced by Twitchy? I wouldn't worry too much about it. You should read the comments on Breitbart. Seems like there's a few white conservatives just itching to shoot a black man.

        •  Oh for sure..... It is a bit scary right now (6+ / 0-)

because this IMO was murder..1st degree but hard to prove.   The minute Zimmerman got out of that car he made a decision to go after that kid and do what was filling up his paranoid mind.. Now ...we have racists galore down here and we also have fair minded people.. Keep in mind ....Zimmerman is also hispanic so it could turn into hispanic white against black or white against black or just all out chaos.   That stupid law is on the books and how many could say they feared for their lives AFTER the verdict on either side... Scary thought.

    •  It was premeditated murder, though (6+ / 0-)

Zimmerman saw Martin, who was innocently walking and talking on his cell phone.  Zimmerman decided to attack Martin.  He killed Martin.  That's murder, and there was premeditation to commit felonious assault.  Thus a killing in the commission of a felony would be felony murder, even if the killing part was not planned.

Murder 2 was thus a compromise.

Martin had every right to fight back once Zimmerman assaulted him. "Stand Your Ground" should have worked in his favor, not Zimmerman's.  Assault does not require actually hitting, either -- that's battery -- but does require creating fear of harm, which a big skinhead with a gun, coming out of an SUV, can easily do.

So Zimmerman's guilty of at minimum felony murder, and any claim of self-defense is meaningless since he was the assailant in a stand-your-ground state.
