    Technically, literacy are legal under Section 1 of the VRA, provided that they are done using the specific procedures set forth in the statute. It was Sections 4 and 5 that suspended them in the racist states where the literacy tests were actually being used to keep Black people from voting.

    So in theory, after last week's brutal Shelby County decision, it is unfortunately quite likely that we will see an increasing movement to impose literacy tests particularly in blue states with high non-English immigrant populations and large populations of Black folks who are older (our most reliable voting bloc) where a 6th grade formal education was all that they got.

    I predict we'll see the first one in less than 6 months unless Congress pre-empts it by reversing Shelby County legislatively.
