  •  FISA Court is creating its own laws (4+ / 0-)

The diarist links to an Ezra Klein article from last Friday. A much better perspective is yesterday's NYT article http://www.nytimes.com/...

If you think John Robert's rulings in Citizens United or his gutting of voting rights act were odious displays of blatant judicial activism (they were of course), then we can only imagine what his hand picked conservative idealogs are doing on the FISA court:

In more than a dozen classified rulings, the nation’s surveillance court has created a secret body of law.... it has quietly become almost a parallel Supreme Court, serving as the ultimate arbiter on surveillance issues and delivering opinions that will most likely shape intelligence practices for years to come, the officials said.
Recall that the crackdown on the Occupy protests, under Obama, was coordinated through DHS, the FBI and the BANKS!!! More than anecdotal evidence exists that the domestic spying apparatus was used to surveil this group as well as other domestic protestors under the guise that they were potential domestic terrorists. Again, all under Obama, and all in secrecy that cannot even be litigated in court. The same Obama is aggressively pursuing an unprecedented war on whistleblowers again under the guise on national security.

In this light it is ironic that diarist asserts:

The president needs a strong congress and a public support behind him to break the chains of the Republican establishment that has been working at least over a half of century to usurp our democracy and civil rights.
Obama is no leader on civil liberties and is working very hard to undermine freedom of the press and to protest. Based on his actions he is, I expect, more than willing to use whatever leeway the secret FISA court gives him. Obama, afterall, is the person who has asserted that in his opinion there is public oversight of all these programs. As to this Obama assertion I would ask:
Where does he reside? On Mars?
