The People are (and should be) invisible to The Government...

unless or until a Crime occurs, in which case, The Gov't should then go looking for evidence with which to prosecute a suspect, whom they find via the evidence they collect.

If they don't find any, then they cannot prosecute anyone for the crime. This is the burden of presumed innocent, upon the Government.

But these modern era Digital Data grabs are supra-Constitutional, it seems to me. Outside of the Constitution, yet given the full force of Law. Coincidentally preserving the very "evidence" which the Gov't might need at some future moment - lo and behold, there it will be, already obtained and simply on hold until needed to prosecute and possibly convict a suspect. That is so very Minority Report - (book version here), it chills me to the bone.

In the end, for me? If my Congress wants to pass Laws which allow My Government to hold secret Courts and thus avoid the view of The People, perhaps even after an arrest or conviction...

Then I want a new fucking Congress.
