    I don't have it, and I don't have Westlaw to look it up, but based on my experience as a litigator, this doesn't seem right.  If you have a cite to a case, I am more than willing to revise my opinion, however.

      that pointed this out -  do not currently have the link and do not have time to search for it but it was a citation of a specific piece of law.
