      McConnell is blowing smoke, and Reid refuses to call him on it.

      I challenge Le Turtle or any of his turtle acolytes to find any law or legal opinion anywhere that defines an illegal nomination.

      The Republicans might be able to make an argument that the recess appointments were illegal, thanks to our now thoroughly corrupt, right-wing judiciary. But there is a big, and very obvious (to any 10 year old with a functioning brain and a dictionary) difference between an APPOINTMENT and a NOMINATION. The President of The United States can nominate whomever the fuck he wants.

      Harry and the craven Democrats have never even pointed this out! We now allow the Republicans to simply make up whatever absolute nonsense they want without calling bullshit. Le Turtle bluffs and blusters precisely because he know he WON'T get called on it.

      And this allows them to take over the control of the NLRB for months -- or possibly longer, because the Repubs will find an excuse to filibuster the new nominees.

      OUTRAGEOUS AND INFURIATING. It is beyond doubt that the second the Repubs take control of the Senate, they will kill the filibuster. And blame it on Democrats. And NPR and the MSM will tell us how both sides do it.

      I will say it again: It is way past time for Harry Reid to step down as Majority Leader.

        by the DC Circuit Court would be to withdraw the recess appointments the court deemed illegal...

        and nominate the same two guys with the Senate in session.

        When you triangulate everything, you can't even roll downhill...

          If the President takes back the recess appointments, the GOP are also claiming that all of their rulings were null and void.  That's over a year's worth of labor cases thrown over to corporations.  It also sets a hugely bad precedent, where the minority can essentially stop Executive Branch agencies from functioning!  They did it simply by blocking nominees and blocking any recess appointments by pro forma gaveling in a few minutes of Congress instead of ever allowing a real recess.  Many who filibustered even admitted it's not the nominee who is unqualified, it's the agency they don't want to exist, an agency which was created by law.
