    using your head - it's arguing your gut. you forget that those that have the power make the laws. slavery was legal. defend that.

    as far as unconstitutionally - i would say and i think everyone who's seriously studied the Constitution would have to say at the very least, it's constitutionally dubious.

    oh pardon me - that's right, there are a few who have studied teh Constitution that wouldn't find them dubious in a constitutional sense; guys with names like Scalia and Alito, and Yoo, and Bybee...
