  •  The bulk of these are fairly easy (4+ / 0-)

    you read the report, "its says here that the officer stopped you because you ran the light and found that you were drinking"  "Yep thats about right"  "Okay, what do you want to do?"  "get me the best deal you can".  

    You read the report, look for probable cause to stop, look for Miranda violations, give it a sniff to see if anything seems hinky and for many cases that is all there is.  The real danger is when you get in that habit and miss the one's that there are defensible issues.  If you find things that are out of the norm, then you push it on and take a look at it, or it goes to a trial department, depending on the jurisdiction.  Its there that the real crunch comes in.  Many of the best PD's are nearly shell-shocked from years of trying serious cases and nearly always have evenings and week-ends routinely spent in the jails or reading files.

    One year I worked every day except Thanksgiving and Christmas.

      most of those in their sleep.

      But as far as inspiring confidence in the system is concerned . . . .

      In fairness, it's almost impossible to get the ADAs on the phone either.

        It wakes you up at 3 in the morning sometimes wondering whether, no not "whether", but what you missed.  One should NOT have confidence in the Criminal Justice System, it is a deeply flawed remnant of medieval thinking that provably does not work.
