    to rewrite the law piecemeal, just as it did for women in the '80s. And there will always be efforts to roll back any rights gained in this way.

    The reason, for both women and gays, is the lack of an Equal Rights Amendment. We need an updated ERA which not only guarantees equality of rights for women but also includes sexual orientation and gender identity.  Something like:

    Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex, sexual orientation, or gender identity.

    Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

    Section 3. This amendment shall take effect two years after the date of ratification.
