    I don't practice it but my BF does. He goes to breakfast with his good ole boy lawyer friends (who don't do BK) every weekend and when he said the BK court can't protect the debtor if it violates state law, they hooted at him and chanted supremacy clause. He just smiled and said we'll see.

    Obviously Rhoades is trying to head off this state law challenge in advance. I don't think the unions will back down.

      is that this one is going to be really, really close.

      I think what settles it is that the BK Court ought to have the power to protect its jurisdiction. So the state court judge ordering Orr to withdraw the petition may have forced the issue.

        Hell fucking no.

        Other state courts answer to a 5-2 GOP Supreme Court.

        Unions can string this out, but they can't win.

        Best-case for the unions is they string this out a few months and a new petition is filed after the Supremes have smacked them down.
