Would send shockwave in the  pro gun ,the State cannot give civil immunity in  a case filed in  Federal District court ,if  Trayvon family is sucessful in getting a judgement against  Zimmerman in a federal court, the ball is now inTrayvon family hand now

    •  I don't think they can sue in civil court. (4+ / 0-)

Regardless of the emotions either for or against the verdict, there are these facts:
      1 He was acquitted.
2 In a court of law.
      3 By a jury.
      4 No mistrial.
      5 No hung jury.

Now, it's my understanding that the acquittal means that the jury found the shooting "justified" (legal term) under statute 776.012

And if a gunfire event is ruled "justified" (legal term) under 776.012 then the acquitted person is shielded from civil suits under statute 776.032

So, to my understanding, the jury verdict put an end to any and all civil suits at the same time that it ended the criminal case.

Just stumbled on all the relevant statutes all on the same page. It's worth a click and a read of the statutes because they include 776.041 "Use Of Force By Aggressor" that the zimmerman jury was NOT told about!

And as a random aside: I can't fucking believe I feel like I have to put justified in quotes and spotlight that it is being used as a legal term so as to try and have a calm discussion of the mechanics of the system rather than be treated as if I am cheering the results. Damn - trying to calmly discuss the trial and the verdict and the law involved has been like trying to explain the concept of laws to my sister that flunked third grade.

          •  Go ahead and report if you got the stones. (0+ / 0-)

Hide ratings are valid for comments that are meant to inflame or do nothing to further discussion.

The comment was the very definition of inflammatory. It does NOTHING beyond attempt to be a sharp stick in the eye of a gun owner.

So, report me if you've got the spine.

Or, just let it go. Because if you dare call attention to it then the upraters just might catch a face full of NR. For uprating a comment that does NOTHING good, only bad.

You maybe should check with the other upraters before you decide. Glen The Plumber, serendipityisabitch, DefendOurConstitution, Lost and Found, poco might like their ability to abuse the ratings system and would likely be cranky if your report backfired on them.

            Have a nice day.

Your comment seems to include all the elements you so self-servingly "define" for deserving to be hidden --- according to you.

And your "sig" seems to be designed to distract and draw as much attention as possible to you and your many notable comments all by itself. Maybe the Admins will notice, maybe not?

It appears your HR was awarded to TheFern for mere disagreement --- or was it actually that you somehow agreed or identified?

Sorry if that somehow put "a sharp stick in the eye of a gun owner."

              Hope you feel better soon.

Have a pleasant day, weekend, and life, JayFromPA.

      •  For you info (0+ / 0-)

A criminal verdict has little or no impact on a  Federal civil wrongful death lawsuit

        •  I'm not seeing that statute. (1+ / 0-)

For what it's worth, the 'not guilty' closed the door to zimm being sued in state civil court.

As for the federal level, I'm only seeing a "Zahau" suit that was recently filed. Googling floods the results with state level data. But, I'm thinking that the Zahau suit may only be going forward because there was no other trial for the murder of mrs zahau.

I'll admit to not being sure about how a federal suit would work with regards to the federal constitution. The zimmerman event is surely a "infamous crime" that triggers a federal suit only on charges from a grand jury, per the fifth amendment. A federal civil suit won't put him in jeopardy of life or limb so 'double jeopardy' may not apply.

However, the seventh amendment establishes that 'double jeopardy' applies to civil type suits, and I am not sure that they can sue federally since the state level suit at common law (civil level) has been closed to them.

It's an interesting angle. It might be available to them but my layman's view sees some doubts.

Are you more educated in this, to be able to speak from definite knowledge?
