      This is why labor law is never addressed because the burden of costs is placed on the shoulders of those screwed out of fair wages.

        in this arena, if a case is taken on contingency then yes, many attorneys do handle the out of pocket expenses for expert witness fees, court reporters, etc., etc..

        Its the trade off for getting that significant part of the settlement at the end.

        It would be interesting to read the Notice of Claim served on the School District in this matter. I've looked for it on-line with no luck yet.

          all court costs and fees were to be paid up front before they would take a case.

          •  It certainly depends upon the type of litigation.. (0+ / 0-)

            and I have no idea yet what the claimants in this case are specifically alleging as damages and will have to wait until I can read the Notice of Claim but off the top of my head and making certain assumptions I would think this matter would have enough of a recovery probability that many VERY competent counsel would say "Contingency".

            Counsel recovers their expenses at settlement and they are not restrained by the financial limitations of their client regarding adequate experts, discovery, etc..

            The GOP and far right hates this system but in many circumstances its the only way that individuals can obtain justice against a larger entity with a stable of insurance defense attorneys at their disposal.
