    I am not a lawyer, so please correct me if I'm wrong here. We know that opposition to climate science is often not based on legitimate scientific debate, but a system of propaganda designed to protect corporate America and energy companies from having to reduce emissions.

    Is it possible that Mann's team can use the discovery process to uncover evidence of the industry-backed efforts to attack climate science? Like, as an example, payments or grants from outfits like the Koch brothers to discredit scientists? We know this stuff is going on, but it would be interesting to uncover specific details.  

    •  discovery needs to show some form of relevance (6+ / 0-)

      now if some of the email mentions Dr Mann
      and has a statement from a funder stating "We need you to keep beating him up", well that's probably relevant
      or a statement from a funder to "Maintain the Doubt
      and attack the message and messenger", that will
      be up to the judge wether it's relevant.

      •  discovery can be pretty far ranging (3+ / 0-)

        and it can be for stuff that would not be admissible for lack of relevance or other reasons. It should be fun.

        One of the reasons for big punitive damages in many cases is the defendant dicking around with discovery — as here.

          you produce your first round of document subpoenas, if the other side squeals, the judge hears it on an open calendar.

          you can also produce written interrogatories and bring people in for depositions.

          i suspect the document production requests will be ugly.
