    What Texas is arguing is that as long as their motives were "pure," they can do what they want, even if the result is a discriminatory effect.  It has been too long since I was in law school and I don't practice in this area of the law, so I simply can't help you on precedent.  I am looking forward to reading Dr. Placebo's comment.
