A judge can find the agreement "unconscionable" and void that part of it, or all of it. A decent labor attorney can help out.

Contracts are often purposely vague containing many grey areas which the contracting party chooses to interpret in a manner most beneficial to them.

I have personal knowledge of this from my lawsuit against a former "employer" when I challenged my "contractor" status with them.

The judge ruled that while independent contractor status was the desired outcome, and that I'd signed an agreement to that effect, the work situation and facts screamed "employee".

The widow can ask the IRS for a determination which was a huge help in my situation.
