One company I knew of many years ago was very thoroughly investigated because an applicant said they used the photos to screen out Blacks.  Happened to be false in that instance, but that's not to say at least some of the companies who do this are using it as a discriminatory tool....

    There is no blanket prohibition against requiring a photograph with an application, but it is not best practice, as it makes it easy for the charging party to show that the employer was aware of his/her protected group membership.  It also raises the question of why there was such a requirement, and whether it actually was intended to screen out minorities/older workers, etc.
