    the frackers and insurers will argue correctly that they should only pay for damage to the watershed caused by fracking.  

    To do otherwise would simply incentivize other polluters.

    Thus you don't avoid issues of proof.

    I think however that this is a good idea anyway, because this is an efficient way to (i) make it in the interest of the frackers to minimize environmental harm and (ii) ensure that the cost of risky practices is felt more quickly by the frackers.
