  •  Okay HERE'S something to cheer about... (9+ / 0-)
In a press release issued this morning, Lynn Ellins, the clerk of Doña Ana county in New Mexico, announced that his office will be issuing marriage licenses to same-sex couples.
New Mexico law is mum on the legality of same-sex marriages. I believe it's because, on the one hand, their marriage statute is gender-neutral while, on the other, their anti-discrimination laws include sexual orientation. At any rate, different people have expressed different opinions on the topic. I think one county began issuing licenses to gay and lesbian couples a few years ago and was ordered to stop.  The state legislature, controlled by Democrats in both houses, would pass a bill affirming marriage equality but the Republican governor would veto it. So a court challenge based on one county taking the initiative may be the way to go. I'm keeping my fingers crossed. For New Mexico AND for Pennsylvania.
