    It's another diary on tax issues written by someone who has no understanding of the code for non-profits or the issue in van Hollen's lawsuit.

    I think the lawsuit will fail because van Hollen has no standing and I believe the Court will toss it on that bases. What very few people seem to understand is that the IRS changed the rule from "exclusively" to "primarily" because Congress passed a new law that was in conflict with the exclusivity rule. My guess is that, if the van Hollen lawsuit isn't tossed on standing, that the Court will rule that this is an issue for Congress to sort out, not the courts. The "primary" rule has been in place for decades and Congress has had lots of opportunities to create a bright line for the IRS, but has chosen not to do it. Why should the courts intervene?
