    that payments are in proportion to damages rather than proportion of misconduct, and because attorneys are paid on contingency, it's not economic to pursue cases unless damages are large.

    Thus, the way damages are calculated, torts are almost never taken up against gerontologists - not because doctors treating old people don't make mistakes, but because the economic damages from the death or even disability of an older retired person are low.

    On the other hand, a mistake that isn't even a mistake but just a bit of bad luck that creates a disabled child is hugely expensive, because that child may require expensive care for the rest of her life.

    Torts aren't a deterrent and they don't compensate people for their injuries or needs or for the fact that said injury might make you ineligible for health insurance (pre 2014).

    Fry, don't be a hero! It's not covered by our health plan!
