    argues that the public good mitigates against meaningfully enforcing laws against the privately powerful, we've already been checkmated.

      Flaring is practice of burning off natural gas as a byproduct of oil production. The volume of flared gas has more than doubled between May 2011 and May 2013. For many years there has been talk about building infrastructure for transport of natural gas to processing plants but nothing has been done "because it would be too expensive." Even when there are pipelines to a processing plant it is still flared.
      There is 3.6 million in fuel loss each day or a 100 million lost each month. Flaring of natural gas releases hazardous pollutants into the environment.
      When natural gas can be exported to other countries the flaring will have driven the price up.
