    I get where you're coming from. The diarist is technically correct ("being shot" means being struck by a projectile fired from a weapon, even a "less lethal" projectile), but he is deliberately misleading in his lead.  That said, he's not trying to fool anyone, he's just being arch to make a mocking point:  engaging in a defensive gun battle is a lot more difficult and dangerous than "arm everyone" enthusiasts imagine it to be.  This legislator cast himself in the proverbial "good guy with a gun" role and showed how easy it was to end up shooting another "good guy".

    There's a lot about this incident that isn't entirely clear, for example what kind of "rubber bullet" was being used.  These can be very dangerous rounds used in riot control, or much safer practice rounds that fire at extremely low velocities. In either case it is a severe firearm safety violation to discharge a weapon pointed at someone, unless that weapon is designed to fire only non-lethal rounds (e.g. airsoft or paintball).  

    The rule is that you always treat a real gun as if it were loaded with lethal ammunition. People have frequently been shot with weapons that were supposedly unloaded for cleaning, or loaded with blanks. The actor Brandon Lee was killed when a blank round was fired from a revolver chamber that unbeknownst to the prop man still had the bullet from a dummy round in the chamber.  Round with propellant but no bullet + bullet from dummy round with no propellant equals a live round.

    Only a fool would engage in an exercise with a bunch of amateurs running around and firing real weapons, no matter what kind of ammo they're supposed to be using.

    The legislator sounds chagrinned by the accident, but not as chagrinned as he ought to be.
