    It can be very hard to document, since verbal/emotional abuse often occurs in private.
    When NY State still required fault for divorce, many courts took the position that a claim of abuse that wasn't physically apparent was a case of he said-she said. So abuse, although technically a valid reason for divorce, was hard to use.
    Many victims didn't have the option of claiming adultery--one of the other grounds for divorce--because it had to be documented, too. If the spouse wasn't cheating or if the victim was kept penniless by the abuser, documentation was impossible.
    Lots of misery was perpetuated by requiring grounds for divorce.
