    All I've read, including on itself, is that anything below 133% of the federal poverty level ($15,232 for 1 person) is covered by Medicaid, and if you fall in that income band but are in a refusenik state, you are not eligible for subsidies, period.  The law doesn't allow for it.

    So you still have that gap between $10,000 and 133% of poverty where you'd be technically subject to the penalty.  Of course, the IRS could be told not to impose it, but that's essentially telling them to ignore the law on the books.
