      -- to me at least -- to be "misconduct."  Misconduct is something like pilfering office supplies or using the company car for personal purposes without express permission or being drunk on the job.

      What's more likely is that if SIL's job was 100% commission, he may be considered an independent contractor and not eligible for unemployment compensation.

      Given that such rules are state-specific, the first thing SIL should do is check with the state unemployment office.
