First, as a matter of law, you are right: the receipt is the company's property.  The restaurant should use discretion.

But the restaurant also has an obligation to make sure the public knows that it respects its workers, and that it wishes to be a responsible corporate member of the community. I would prefer if the restaurant had some sort of PSA, perhaps on Facebook or some other social media site.

Get a graphic designer to do a fake receipt that says n***er on it, or something else offensive, and have a Facebook campaign with the receipt and a mug shot that says "if you do this at a Red Lobster, we'll make sure you turn red, too..." and in small print:

"We value our guests and want everyone to come to Red Lobster.  But we value our employees also.  They are family.  If you use racial slurs against them, we will ask you to leave our restaurant and not come back.  If you use your company card, we will notify your company of your behavior."

    •  That's a good idea. (4+ / 0-)

and certainly I would fully support a push to have a restaurant do this.  And I would have supported this waitress had she asked for something like this.

She was wronged by a customer.  She had a right to ask the company to do what THEY could to try to make sure it doesn't happen again.

What she did not have the right to do is to take it upon herself to post the company's business records on line, putting the company at risk of potential liability to Mr. Racist Customer, who might well sue the company if he gets harassed (and might well win) because the company (through her) violated its own policy of NOT making this stuff public.
