    It also would be both Constitutional and legal, if the NSA attacked a foreigner outside the United States with this approach.  (With or without a warrant.)

    It would definitely be both illegal and unconstitutional if it were done to anyone within the US, and probably so if it were done to a US citizen outside the US. (Without a warrant - would be legal if there was a warrant.)

      Huge qualifier and a necessity for the constitutionality of this since that would require specificity.
