        But it appears that the heart of this attack was a shotgun purchased at a gun store, which would have meant that he passed the background check.

     

    Yet here in the immediate wake of a massacre with the very weapon that is at the heart of legislation like the now-repealed AWB
        If there actually was an AR-15 involved in this incident, (which is not yet clear,) it was apparently taken from either the security post where the shooting started, or from the Washington Metro police officer who was shot. The AWB would not have prevented this.
         The incident involving shooting out the tires of another person in 2004 in Washington state, which could have resulted in felony charges, apparently was never charged because the police lost the paperwork. It should have at least resulted in some extensive mental health care. He should never have been able to get the CCW permit in Texas, and should not have been able to pass the background check, but he apparently did.
         Improved background checks, (and more efficient police work in 2004,) might have prevented this, as well as better mental health care. A reinstituted AWB, or any other increased restriction on guns, would not, unless you plan to ban access to hunting shotguns.

        the use of a gun in the commission of a crime makes the underlying crime a higher level felony, or in which the gun use in the commission of a crime is a separate felony with its own substantial penalty, are very frequently dropped in the course of plea bargaining. Additionally, the specific charges of domestic abuse, ("fifth degree assault" in Minnesota, as I recall,) are often lowered to "disorderly conduct" or something similar, which no longer triggers the NICS check that is supposed to prevent abusers from obtaining guns.
