      It's important to remember that the question of whether same-sex couples deserve to be treated equally is not an issue in the current case; the NJ Supreme Court has already ruled, unanimously, that they do (Lewis back in 2006). The only issue in this case is whether civil unions provide that equality (the NJSC ruled 4-3 in Lewis that they would, but this was before Windsor and in any case a legislative commission concluded that CUs did not in fact provide full equality).

      Thus most of the standard anti-equality arguments won't have any force in the appeals because they address a question that's already settled, and the NJSC would have to overrule its own prior decision in Lewis in order to find for the state. NJ is the only state with this kind of existing precedent.
