      This is the same scenario as California, where pro-marriage equality groups sue the state, the district court judge strikes down the anti-gay ban and the Governor and AG refuse to appeal, resulting in a win by default for marriage equality.

      In Virginia, Terry McAuliffe and Mark Herring would almost certainly refuse to appeal an "adverse" ruling to the state's anti-gay ban.  In PA, the Attorney General has already said she won't defend the law, all that will now be needed is a Governor who will do the same.  Guess what, the GOP Gov. Tom Corbett is the most likely incumbent to lose in 2014.
